Definitions

This is an agreement between You (the “User”) and Dimension3 Learning Technology Limited (“Dimension3”, ”Ultranet”, “we”, or “us”) to use our services (“Services”) such as the Ultranet website and associated applications.

If you are too young in your country of residence to legally agree to these terms of use, then you should review them with your parent or guardian and make sure that you and your parent or guardian understand them.

By using our Services you are agreeing to these terms of use. Please read them carefully.

 

The short story

You agree not to break our stuff or do illegal things. We agree to do our best to provide you with great service and to look after your content. Of course, this is all subject to the terms of use as listed below.

 

Using our Services

You agree not to misuse our Services, interfere with them or try to access them in any way other than the methods that we provide to you. This includes, but is not limited to, directly accessing web services or Application Programming Interfaces (API), interfering with the data transferred between our services and your device, uploading third party code or altering our Services in any way.

Using our Services does not give you ownership of any intellectual property rights pertaining to our Services. You may not reuse branding or logos from our Services without permission from us.

Our Services display content that is not ours. Responsibility for that content rests with whoever makes it available. We do not review content to determine if it is illegal. However, we may remove such content if we reasonably believe that it violates the law.

You may only use our Services only as permitted by law. We may suspend or stop providing our Services to you if you fail to comply with our terms of use or if we are investigating misuse of our Services.

 

Your Ultranet Account

You must have an Ultranet Account to use our Services. You may create your own account, or one may be created for you by a school or institution administrator. Your account may be accessed by an administrator when you are enrolled in a school or organisation as part of our Services. Your account may be accessed by us for the purpose of diagnosing issues, or investigation of misuse or tampering with our Services.

If your account has been created for you, you may be subject to additional terms of use as required by the institution which created your account. In that case, use of our Services when accessing the institution content constitutes acceptance of those terms.

If you learn of unauthorised access to your account, you must contact an administrator at an institution in which you are enrolled. If you are not enrolled in any institution, you must contact us directly.

 

Your content

You are responsible for any and all information that you upload to, or store on, our Services. As such, you warrant that any content you do upload does not infringe applicable copyright or privacy laws, and does not contain content that is defamatory, offensive or unlawful.

You retain ownership of any intellectual property rights for content that you upload to our Services. When you upload or submit content to our Services, you grant us a worldwide, royalty-free, non-exclusive license to host and use the Content in order to provide you with the Services. You must ensure that you have sufficient rights to grant us this license.

 

Privacy

By using our Services, you agree that we can use your information in accordance with our privacy policy. This policy covers:

  • Information we collect from you;
  • Information we collect from your use of our Services;
  • How we use the information we collect;
  • Accessing and updating your personal information;
  • Information we share.

 

Warranties and Disclaimers

We provide these Services using a commercially reasonable level of skill and care. We do not warrant this service as being without defect. This includes—but is not limited to—functionality, accuracy or quality of content and accessibility to content or our Services.

Unless specifically covered by other agreements, our Services are provided “as is”.

In no event shall Dimension3 be liable for any consequential or indirect damages, or losses due to disruption of service, loss of content, or any other such issues unless covered by other agreements.

 

Beta Services

From time to time we may make beta versions of our services available. These “Beta Services” are made available for the purpose of showing you new functionality that we are working on, and to gather feedback from real users to help us determine how to provide you with the best product.

Beta Services may not always be available, may not be complete, and may have issues. We reserve the right to take a Beta Service offline at any time.

We will endeavour to provide you with the best experience possible. However, we may take Beta Services offline at our discretion. We will also endeavour to make sure your data is accessible. However, we do not promise or guarantee that your data will be retained or made available for download.

Beta Services are provided on an “as is” basis.

 

Updated terms of use

From time to time, we will update the conditions covered by these terms of use. Updated terms will replace all existing terms, and will be made available on our website. It is your responsibility to review these terms.
